First responders arrived to find Heidi dead at the scene and Nick with a gunshot wound to his leg. Nick claimed that during a struggle with the intruder, his shotgun accidentally discharged, hitting Heidi. The supposed intruder then fled, leaving the couple in their desperate situation.
Investigation and Discrepancies
Investigators quickly cordoned off the scene and began speaking to neighbors. Despite Nick’s claims of an intruder, no one saw anyone fleeing the Firkus home. Neighbor Brendan O’Connor, who was house-sitting next door, reported hearing a muffled argument followed by gunshots and a voice shouting, “You shot her, you shot me, please, please, no.”
Nick’s account of the events raised several questions. He described hearing someone fiddling with the front doorknob, grabbing his gun, waking Heidi, and rushing her downstairs before confronting the intruder. According to Nick, a struggle ensued, resulting in Heidi being shot in the back as she tried to escape.
Financial Troubles Come to Light
During the investigation, it was revealed that Nick and Heidi were facing significant financial troubles. They were behind on their bills and had lost their home, with an eviction scheduled for the next day. Arrest and Trial of Nick Firkus
On May 19, 2021, eleven years after Heidi’s death, Nick Firkus was arrested and charged with second-degree murder. A grand jury later indicted him on first- and second-degree murder charges. During the trial, prosecutors argued that Nick staged the burglary due to the shame and desperation over their financial collapse. They presented a 3-D model of the Firkus home and animations to demonstrate the improbability of Nick’s account.
Defense attorneys argued that there was no motive for Nick to kill Heidi, pointing to tool marks on the door as evidence of an intruder. However, prosecutors countered with the lack of Heidi’s DNA on the gun and the financial deception Nick had maintained.
Verdict and Sentencing
After an 11-day trial, Nick Firkus was found guilty on two counts of murder on February 10, 2023. He was sentenced to life in prison without the possibility of parole. Despite his conviction, Nick maintained his innocence, declaring he would do so until his dying breath. Nick’s family continues to support him, believing in his innocence, while he appeals the conviction.
